Terms & Conditions

Last updated May 26, 2026. These Terms govern survey drafting services provided by Terradrafts (“we”, “us”) to clients located outside our home jurisdiction (“you”, the “Client”).

1. Acceptance

By submitting a project, paying an invoice, or downloading any deliverable from us, you accept these Terms in full. If you are engaging us on behalf of an organisation, you confirm you are authorised to bind that organisation.

2. Scope of Services

We provide survey drafting, drone data processing, LiDAR point-cloud processing, paper-to-CAD conversion, volume reporting and related deliverables, drafted to the standards and coordinate system you specify at quotation.

Each engagement is defined by the written quotation or estimate we send you. Anything outside that quotation is treated as a change request and may affect price and delivery time.

3. Client Data & Inputs

You warrant that you own or have the right to share any data you upload (drone imagery, LiDAR scans, total-station records, paper plans, etc.) and that doing so does not breach any third-party rights, NDA, or local law in your jurisdiction.

We rely on the accuracy of the data and standards you provide. We are not responsible for errors in deliverables that stem from inaccurate, incomplete, or mis-georeferenced inputs.

4. Turnaround & Delivery

Standard turnaround is communicated per project, typically within 24–72 hours of receiving complete inputs. Time zones are handled on our side; you do not need to be online for hand-off.

Deliverables are issued in the formats agreed at quotation (DWG, DXF, PDF, LAS/LAZ, OBJ, etc.) via secure download.

5. Fees, Currency & Payment

All fees are quoted and invoiced in USD unless otherwise agreed in writing. International bank fees, currency-conversion costs, and local withholding taxes are the Client’s responsibility.

Unless stated otherwise, invoices are payable within 7 days of issue. We reserve the right to withhold final deliverables until payment clears.

6. Revisions

Each deliverable includes up to two rounds of revisions against the original brief at no extra cost. Additional revisions, or changes that expand the original scope, are billed at our standard hourly rate.

7. Intellectual Property

On full payment, you receive a worldwide, perpetual licence to use the final deliverables for the project they were prepared for. We retain ownership of our underlying templates, scripts, tooling, and know-how.

We may reference the project (non-confidential aspects only) in our portfolio unless you opt out in writing.

8. Confidentiality

We treat your project data as confidential and do not share it with third parties except subcontractors bound by equivalent confidentiality obligations, or where required by law.

9. Data Protection (Cross-Border)

Project files are stored on secure cloud infrastructure that may be located outside your country. By engaging us, you consent to the cross-border transfer and processing of your project data for the purpose of delivering the services.

Files are retained for up to 12 months after delivery, then archived or deleted. You may request earlier deletion in writing.

10. Warranty & Professional Use

We deliver work using reasonable professional skill and care, to the standards specified by you. Deliverables are intended as drafting outputs to support decisions made by a licensed surveyor, engineer, or other qualified professional in your jurisdiction. They are not a substitute for on-site verification or local certification.

11. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of an engagement is limited to the fees actually paid by you for the specific project giving rise to the claim.

We are not liable for indirect, incidental, or consequential losses, including lost profits, lost contracts, delay damages, or losses arising from reliance on deliverables without independent verification.

12. Cancellation

You may cancel an active project at any time. Work completed up to the cancellation notice is billed pro-rata and any partial deliverables are released on payment.

13. Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet or cloud-provider outages, sanctions, or government action.

14. Export Controls & Sanctions

You confirm that engaging us, and our delivery of the work, does not breach any export-control regulation or sanctions regime applicable to you or to the project location.

15. Governing Law & Disputes

These Terms are governed by the laws applicable at our principal place of business. Any dispute will first be addressed through good-faith negotiation; if unresolved within 30 days, the parties agree to binding arbitration conducted remotely in English.

16. Changes to These Terms

We may update these Terms from time to time. The version in force for your engagement is the one published on this page on the date we accept your project.
